Once title is perfected, the buyer should notify the occupants, in writing that they are the new new owners. Notice must be in writing, and should have contact information of the new owners. We suggest delivering personally, or by posting the notice on the door if no one answers the door.
Many experienced trustee sale buyers have found that they are successful in gaining possession by offering an immediate payment to tenants, if they will promise to move by a certain date. Before calculationg an amount to offer, try to put yourself in the occupant’s shoes. These tenants have a serious problem that they have to solve. Usually that means finding another place to live on short notice. Renting another home costs thousands of dollars. They probably haven’t enough money to move out. You need to help them solve their problem, so they can help you solve yours. Don’t rent the property to these tenants.
If tenants accept your move out offer, meet them in person on the day they have notified you they will be completly out. You hand them a cashiers’s check or cash, and they hand you the keys. Be sure tenants are physically outside of the property .
