There are two types of no fault evictions in the City of Los Angeles. First, there are the no fault evictions permitted under the City’s Just Cause Ordinance (JCO). Second, there are the no fault evictions authorized by Los Angeles’ Rent Stabilization Ordinance (RSO).
The JCO was passed by the LA City Council in January 2023. The JCO covers most residential properties in the City of Los Angeles that are not regulated by the RSO, including single family dwellings. If your property is in the city of Los Angeles and not covered by the RSO, you are probably covered under the JCO.
No Fault Evictions under the JCO
The JCO established eviction control on residential properties that have historically been exempt from rent control in LA, including single family homes. There are several allowable no fault reasons for eviction in the city of LA under the JCO. They are:
Owner or family member move in
Owner plans to substantially renovate the dwelling
Owner plans to permanently withdraw the unit from the rental market
Unit must be vacated pursuant to a government order
The government is the owner and wants to sell the property
The property is a residential hotel
The owner wants to convert the property into affordable housing
The owner plans to convert the property to non-residential use.
No Fault Evictions under the RSO
Here are the most common no fault eviction reasons in Los Angeles under the RSO:
Owner or family member move in
Owner plans to renovate the dwelling
Owner plans to demolish or permanently withdraw the unit from the rental market
Pursuant to a government order
The Government owns the property
The property is a residential hotel
The property will be converted to affordable housing
If your situation does not fall within one of these no-fault reasons for eviction, you will not be able to evict unless you have an “at fault” eviction reason permitted by one or both of the Ordinances.
